On April 2, 2026, Law No. 15,377/2026 was enacted, amending Brazil’s CLT to introduce new employer obligations relating to employee health awareness.
The law adds Article 169-A to the CLT, requiring employers to provide employees with information on official vaccination campaigns, as well as on the prevention of HPV and breast, cervical and prostate cancers, in accordance with guidelines issued by the Ministry of Health.
In addition to providing information, employers must promote internal awareness initiatives and guide employees on how to access relevant diagnostic services. Employers are also required to inform employees of their statutory right to take up to three days’ paid leave within a 12-month period to undergo preventive medical examinations, as provided for under Article 473, XII of the CLT.
To comply with the new requirements, employers should implement appropriate internal communication and awareness campaigns covering the topics specified in the law. Employers are also advised to retain records of these communications and initiatives as evidence of compliance in the event of regulatory scrutiny.
