Revised sick leave indemnity framework

As of 1 August 2025, Romania has implemented new rules regarding the calculation of sick leave indemnities for temporary work incapacity caused by common illnesses or non-work-related accidents. 

Previously, the indemnity was set at 75% of the employee’s average monthly income over the last six months of the 12-month contribution period, capped at 12 gross national base salaries.

Under the new rules, the percentage of indemnity is now tiered based on the duration of the sick leave, as certified by a medical certificate:

  • Up to seven days: 55% of the calculation base.
  • 8 to 14 days: 65% of the calculation base.
  • 15 days or more: 75% of the calculation base.

Depending on the actual disease, the level of indemnity could be higher irrespective of the medical leave duration.

Sick leave certificates issued before 1 August 2025 will continue to be governed by the legal framework in force at the time of issuance.
