New accreditation for companies that promote mental health

  • A new law was enacted on 28 March 2024 creating a new mental health accreditation for employers.
  • Companies which meet certain criteria may now be awarded a Certificate for Companies that Promote Mental Health (Certificate).

On 28 March 2024, Law No. 14.831 of 27 March 2024 was enacted, creating the Certificate and establishing the requirements for the granting of the Certificate by the federal government to companies that meet certain criteria for promoting the mental health and wellbeing of their workforce.

Actions and policies related to the promotion of mental health include: 

  • the implementation of mental health promotion programmes at work;
  • access to psychological and psychiatric support resources for employees;
  • promotion of mental health awareness through campaigns and training;
  • regular evaluation and monitoring of implemented actions and their adjustments;
  • promotion of a safe and healthy work environment;
  • encouragement of physical activity and leisure pursuits, healthy eating habits, and integrative communication.

In relation to actions and policies concerning transparency and accountability, companies must: 

  • regularly share information through their communication channels about the initiatives and policies which are aimed at promoting mental health and employee wellbeing;
  • maintain a channel for receiving suggestions and feedback; and  
  • encourage the development of goals and periodic analysis of results relating to the implementation of mental health initiatives.

A commission appointed by the federal government, in accordance with regulations yet to be issued, will be responsible for verifying that a company's practices to promote the mental health of its workers comply with the requirements established by law and granting the Certificate. 

Once obtained, the Certificate will be valid for two years and non-compliance with the requirements established by law may result in the revocation of the Certificate.

Companies that receive the Certificate are allowed to use it in their communication and promotional materials to demonstrate their commitment to the mental health and wellbeing of their employees.
