A previous update discussed the approval of the Act by the Dutch Senate on 11 November 2025. This included the introduction of a licensing system for companies that post workers, the rule that hirer companies may only work with licensed companies, and the licensing requirements. Since then, the entry into force, the licensing authority and the standards framework have been further specified.
The entry into force has now been definitively set. The Act will enter into force in phases. Implementing parts, such as the public register, will apply from 1 July 2026. The licensing system itself will enter into force on 1 January 2027. The prohibition on posting workers without a license and enforcement by the Netherlands Labour Authority will follow on 1 January 2028.
The licensing authority is now also known. Applications will be assessed by the Dutch Labour Posting Market Authority on behalf of the minister. In addition, the standards framework has been published. A company that posts workers must comply with this framework in addition to the known conditions. The standards framework contains two groups of standards for correct and careful employment practices:
- General requirements: The identification of the undertaking, the filing and payment of payroll taxes and VAT, the processing of the financial administration, the cash administration, the use of a blocked account and the provision of information and documents.
- Requirements when posting workers: The identification of the worker, the employment contract, the forwarding of information, housing, payroll administration, the linking of hours, and the hiring-in and onward posting of personnel.
Private inspection institutions will assess whether a company that posts workers complies with the framework. Licensed companies that post workers must submit a new inspection report every twelve months. If a company no longer complies with the standards framework, the license may be suspended.
Existing companies that post workers can register for the transitional scheme from 1 November to 31 December 2026 via toelatinguitleenmarkt.nl. They may then continue to post workers while the Dutch Labour Posting Market Authority assesses their application. The formal license can be applied for from 1 May to 30 June 2027.
