Saudi Arabia introduces framework for overseas contracting of nationals

The Saudi Council of Ministers has issued Decision No. (802) dated 11/11/1447H, approving a new regulatory framework governing the contracting of Saudi nationals for overseas assignments. The decision was published in Official Gazette No. 5158 on 8 May 2026.

The framework applies to government entities engaging Saudi nationals to work in diplomatic missions, attachés, and technical offices abroad. It establishes clear eligibility criteria for candidates, including Saudi nationality, minimum age requirements, appropriate qualifications and experience, medical fitness, and security clearance. Individuals subject to disciplinary dismissal or ongoing legal proceedings are restricted from contracting unless specified conditions are satisfied. In addition, government entities must obtain workforce planning approvals from the Ministry of Human Resources and Social Development.

A structured remuneration and benefits regime is introduced, comprising a basic salary determined by an official salary scale, alongside a range of allowances. These include housing allowances set at 25% of base salary, transportation allowances capped at 10% of base salary, medical insurance, and education support for dependants. Additional entitlements include relocation allowances, hardship allowances for designated locations, and travel benefits in accordance with applicable policies.

The decision also requires the issuance of unified administrative regulations within 90 days to govern contracting procedures. The framework will enter into force 120 days from its publication. Government entities are required to implement the framework within existing budgetary allocations, without creating additional financial burdens on the state. A review of the framework will be undertaken after three years to assess its effectiveness and address any implementation challenges.
