Proposed birthday leave reform in Mexico

On 7 January 2026, Deputy Armando Corona Arvizu introduced a bill to add Article 74 Bis to the Federal Labor Law. The bill proposes granting employees a mandatory paid day off on their birthday or, alternatively, requiring employers to pay double salary if an employee works on that day.

To access this optional leave, employees would need at least six months’ seniority and must give their employer no fewer than 15 business days’ notice. Employees with less than six months’ service would receive proportional paid leave.

The proposal also contemplates penalties for employers who fail to grant the leave. It is currently under analysis by the relevant congressional committee.
