Planned amendment to the Act on the Promotion of Employment

The Polish government has recently published a draft bill to amend certain laws with a view to deregulating economic and administrative law. 

The draft bill provides for a number of comprehensive amendments to the scope of many legal sectors, including an amendment to the Act. The proposed amendment to the Act envisages that liability for an offence involving the illegal employment of a foreigner will only occur if the employer acted intentionally. Until now, employers are liable regardless of whether they acted intentionally or not.

The amendment of the Act is a response to calls from groups of employers who have been highlighting the complexities in the process of employing foreigners.

The bill is still at the opinion stage. It has passed through the stage of arrangement and public consultation, but it has not yet been referred to parliament. The authors of the bill expect the new regulations to come into force on 1 January 2025.
