Developments in Romanian immigration law

At a glance

  • Romanian immigration legislation has been updated in several stages from the end of January 2024 until present. 

The key changes include:

  • implementing the ability to electronically transmit work permits;
  • transposing EU Directive 2021/1883, which changed the rules / procedures for obtaining a work permit for highly skilled workers, making the process more complex than it was previously (now being similar to the process for obtaining a work permit for a permanent employee);
  • enacting the law to implement EU Council Decision 2024/210 which imposes additional requirements on employers who hire foreign individuals, such as requiring the employer to have been active in the field for which they are requesting the work permit for at least one year; and the employment contract with the prospective employee having to be signed within 15 working days of their arrival in Romanian territory etc; and
  • modifying the content of the residency permit for beneficiaries of temporary protection, which must now include their residential address in Romania.
