  • On 10 March 2023, Act No.211,545 was published in the Official Gazette to promote the inclusion, comprehensive care and protection of the rights of people with autism spectrum disorder in the social, health and educational fields.
  • We provide further detail on the Act below.

The Act establishes a new right for parents or legal guardians of minors diagnosed with autism spectrum disorder.

Employees governed by the labour code and public officials will have the right to take time off work to tend to emergencies faced by their children who are in pre-school, elementary or secondary education and are diagnosed with autism spectrum disorder.

Employers may not use this form of absence to establish grounds for termination for unjustified job abandonment.

The time spent by employees tending to these emergencies will be considered working hours for legal purposes.

Further, employees must inform respective Labour Inspection if they have a minor under their legal guardianship, diagnosed with autism spectrum disorder.
