At a glance

  • Our tracker on implementation of the Platform Work Directive (PWD) has been updated.
  • No Member State has yet fully transposed the PWD, and most are still at the preparatory, consultation or drafting stage. Only Slovakia has final legislation due to come into force on 2 December 2026.

No Member State has yet fully transposed the PWD, and most are still at the preparatory, consultation or drafting stage. The PWD gives Member States significant discretion. The clearest example is the rebuttable presumption of employment. The adopted text contains no criteria for direction and control, which are left to national law, collective agreements or practice, taking account of the European Court of Justice’s case law. As a result, the presumption is likely to work differently from one Member State to another.

The Expert Group Report provides some guidance

In January 2026, the Commission published the report of its Expert Group on the transposition of the PWD (Report). The group was made up of national experts from all 27 Member States, the EEA/EFTA States and the European social partners. The experts raised questions, and the Commission services answered them. The Commission services are the Commission's administrative staff in its Directorates-General, not the College of Commissioners, which takes the Commission's formal decisions.

The Report is not legally binding. It does not represent the position of any government, the Commission or the social partners. The answers reflect the views of the Commission services only. Even so, the Report is a good indicator of where national laws are heading, because many of the experts are drafting their own countries' implementing legislation. For further details on the Report’s indications, please visit our summary on the EU Directive Tracker.
