Further amendments to Romania's medical leave framework

  • From 18 May 2026, where medical leave relates to a single continuous period of illness or related complications, the indemnity will be calculated by deducting only one day, regardless of the number of medical certificates issued.
  • From 1 June 2026, (1) maternity leave, (2) maternal risk leave, (3) leave to care for an oncological patient, and (4) medical leave for patients enrolled in national health programmes or receiving inpatient care are excluded from the temporary rule under which the first day of medical leave is unpaid. As a result, the first day of these types of leave will be paid. Secondary legislation is expected.
  • The remaining temporary amendments relating to the calculation and payment of medical leave indemnities will continue to apply in full to medical certificates issued between 1 February 2026 and 31 December 2027.
