Employers in the ADGM are reminded of their ongoing duty to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and to consider whether additional measures are required to meet this obligation.
The FAQs confirm that temporary remote working arrangements (inside or outside of the UAE) are permitted where feasible, and employers should consider any associated immigration, tax or regulatory implications as a result. Where an employee is outside the UAE and unable to return or work remotely, alternative arrangements may be agreed, including using vacation leave or, where it has been exhausted, unpaid leave.
Salary payments must continue in accordance with the employment contract, and any reduction is only permissible where authorised under ADGM legislation, with employee consent or other applicable legal mechanisms.
The FAQs encourages all working arrangements to be documented and signed by both parties.
