  • The Spanish government has introduced a draft law to regulate artificial intelligence (AI) in accordance with EU regulations.
  • The draft law outlines prohibited uses, penalties, responsible authorities, and measures to promote innovation in AI and quantum technology.

The draft law aims to align Spanish legislation with the European Union's AI Act. It emphasises the promotion of ethical, inclusive, and beneficial uses of AI technologies.

The law combines regulatory measures with initiatives to foster innovation. It seeks to create a balanced environment where AI can develop while ensuring safety and ethical standards.

The law prohibits the use of hidden techniques that:

  • Manipulate individuals without their awareness.
  • Exploit vulnerabilities, particularly those of specific groups such as children or the elderly.
  • Classify individuals based on race, political orientation, or other sensitive attributes.
  • Establish a social scoring systems that evaluate individuals based on their behaviour or characteristics.
The law also defines what constitutes high-risk AI systems, including those used in critical infrastructure, education, employment, and law enforcement. It sets strict obligations for the deployment of these systems, including comprehensive risk management protocols and mandatory human oversight, in line with EU regulations.

The law establishes a framework for penalties in cases of non-compliance. Sanctions can range from fines to the withdrawal of harmful AI systems from the market, ensuring accountability and adherence to the regulations.

Finally, the law introduces the concept of controlled testing environments, known as sandboxes. These sandboxes allow for the safe and regulated testing of AI innovations, helping developers to comply with legal requirements while fostering technological advancement.

This draft law aims to ensure that AI technologies are developed and used in ways that are ethical, inclusive, and beneficial to society.
