New obligations for hiring persons with disabilities

At a glance

  • Employers with 50 or more employees must ensure at least 4% of their workforce are persons with disabilities or follow alternative legal measures.
  • Employers must seek assistance from non-governmental organisations (NGOs) supporting persons with disabilities and provide job details.
  • Employers must also submit proof of NGO requests to the National Authority for the Protection of the Rights of Persons with Disabilities and the National Agency for Employment.
  • Annual reports must also be filed.

Employers with at least 50 employees are required to either:

  • ensure that 4% of their workforce consists of persons with disabilities; or
  • adhere to the alternative measures prescribed by law.

While this general rule remains unchanged, employers now have additional obligations:

  • They must provide written proof that they have sought assistance from at least three NGOs that support persons with disabilities (in the area where the company is based) within ten days from the date on which the employer has fulfilled the total headcount requirement under the law. This request should detail the job duties, required qualifications, and working hours for the positions (a template form has been made available).
  • They need to submit this request and proof of submission to the National Authority for the Protection of the Rights of Persons with Disabilities and the Territorial Unemployment Work force Agency.
  • Annually, for the previous year, by 31 January, employers must submit a report to these authorities (a template form has been made available) detailing the positions filled by persons with disabilities and the skills required for these roles.
