New obligation in Spain requiring sustainable transport plans for employees

Law 9/2025 on Sustainable Mobility, published in Spain’s Official Gazette on 4 December 2025 and effective from 5 December 2025, establishes a comprehensive framework to promote sustainable mobility nationwide. Aligned with Agenda 2030 and international climate commitments, the law aims to reduce emissions, improve air quality, and ensure efficient, inclusive transport systems.

A key requirement is the introduction of PMST. All work centres with more than 200 employees or 100 employees per shift must negotiate and implement PMST within 24 months (by 5 December 2027). Plans should include measures to encourage collective and low-emission transport, active mobility, teleworking options, charging infrastructure for zero-emission vehicles, and road safety. Coordination with local mobility plans is mandatory, and large centres with over 1,000 employees in metropolitan areas face additional obligations to reduce congestion.

Companies must submit biannual progress reports. Failure to comply is considered a minor offence, subject to fines of EUR101 to EUR2,000 and a six-month limitation period. The law also amends Article 85 of the Workers’ Statute, requiring collective agreements to incorporate PMST measures.

Law 9/2025 represents a significant shift in corporate mobility responsibilities, embedding sustainability into workplace transport planning and supporting Spain’s climate objectives.
