- The new 'employee choice' pathway for conversion from casual to permanent employment is now in effect for many employers.
New changes, introduced under the Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024, mark a shift in responsibility from employers to employees insofar as a conversion from casual to permanent status is concerned.
Until 26 February 2025, employers remained responsible for offering conversion to casual employees who met the relevant criteria. Since this date, eligible casual employees are now themselves able to initiate a request for conversion to permanent employment under the new framework if they believe they no longer meet the definition of a casual employee under the Fair Work Act 2009.
For small businesses, this change will take effect from 26 August 2025.
