It is time for employers to review staffing arrangements

  • In 2022, Swedish employment law was significantly reformed. One notable change concerned an entitlement that was granted to agency workers which allowed permanent employment under certain circumstances.
  • It was determined that an agency worker is entitled to be a permanent employee of a customer or can be paid the equivalent of two month’s salary (or three in some cases), where they have worked on a customer site for more than 24 months in a 36 month period.
  • This entered into effect on 1 October 2022, and therefore the first 24 months will come to an end later this year.
  • Employers who rely on external labour are therefore encouraged to review their agency worker arrangements in order to avoid either having to increase headcount or to pay the additional fee to the agency workers.
