Congress enacts laws on the prevention and treatment of endometriosis

On 12 October 2023, Law 2338 of 2023 entered into force. This law establishes the guidelines for public policy on prevention, early diagnosis and comprehensive treatment of endometriosis.

It has been established under article 9 of Law 2338, that female employees who have been diagnosed with endometriosis can agree a flexible working schedule with their employer, including the opportunity to work remotely. The law does not however set forth a procedure in which such a request should be made. Employers have been advised to apply the same procedures which they use to manage absences and leave, and apply these in an objective manner. 

It was also specified, that a female employee with this diagnosis is entitled to medical leave which is accorded to the regulations set by the Ministry of Health and Social Protection.
