New consultation obligation for employing third-country nationals

  • The Hungarian Government has significantly tightened its rules on the entry and employment of third-country nationals.
  • This trend is also reflected in the recent amendment to the Hungarian Labour Code.
  • From 11 May 2024, employers will be required to consult with the works council if their total employee headcount is made up of 5% third-country nationals, and again for each additional 5% after that.
  • Although the works council has no authority to block decision and cannot prevent the employment of third-country nationals, the consultation obligations create more transparency within the workplace.
